In consideration of your accepting my application in racing events by Castaways Sailing, Inc. or the Palm Beach Sailing Club, I hereby waive, release, hold harmless and discharge any and all claims for death, personal injury or property damage which I may have, or which subsequently accrue to me or my crew, as a result of my participation in yacht racing. The release is intended to release and hold harmless the promoters, sponsors, the promoting club(s), the officials, any involved municipalities and other public entities, and the United States Sailing Association from and against any and all liability arising out of or connected in any way whatsoever with my participation in yacht racing, even though that liability may arise out of the negligence or carelessness on the part of the persons or entities mentioned above.

I further understand that serious accidents occasionally occur during yacht racing and that participants in yacht racing occasionally sustain mortal or serious injuries, and/or property damage, as a consequence thereof. I knowingly assume the risks of yacht racing and hold harmless all of the persons or the aforementioned entities that might otherwise be liable to me or my heirs or assigns for damages. I further acknowledge that the decision to race is solely that of the vessel skipper and that the skipper is responsible for any and all actions by his/her crew.

It is the skipper’s responsibility to obtain a signed release from each member of his or her crew before the race begins. In the event that the captain fails to obtain a release from a crew member, the captain aggress to protect, indemnify and hold harmless the aforementioned persons or entities from any claims for damages or compensation that that they may have to pay arising from injuries to that crew member due to the negligence of the aforementioned persons or entities.

I agree to abide by all Regatta Notices and Sailing Instructions for those events and rules of the United States Sailing Association.
